1. Introduction

This data protection declaration applies exclusively to all websites operated by TEXSPO Ges.m.b.H, Industriezeile 36/1, 4020 Linz (hereinafter referred to as “OFFTEX” or “we” for short).
If you work with OFFTEX or TEXSPO, entrust us with your data. We take the protection of your personal data very seriously and observe the applicable legal provisions for the protection, lawful handling and confidentiality of personal data, as well as for data security, in particular the Austrian Data Protection Act (hereinafter referred to as “DSG 2018”), the EU General Data Protection Regulation (im Hereinafter referred to as “GDPR” and the Telecommunications Act (hereinafter referred to as “TKG”) as amended.
This data protection declaration is aimed at all users of arztwerbung.at.
This data protection declaration tells you what data we collect, for what purposes we collect data and what we do with the data we collect. As this is important, you should take the time to read this provision carefully.

 

2. Which data are processed and from which sources do these data come

We process data that we receive from you as part of the business initiation and relationship. This includes in particular the following data:
Address data
Customer data (master data, address, service provider, communication)
Bank details

 

3. For what purposes and on what legal basis are the personal data processed?

We process the data you provide for the following purposes:
Contract initiation and contract fulfillment: In order to be able to provide our range of services to your complete satisfaction, we need your data.
Fulfillment of legal obligations: Processing your data is for the purpose of fulfilling different legal obligations e.g. of the Federal Tax Code with regard to retention requirements.
As part of your consent: If you have given us your consent to process your data, processing will only take place in accordance with the purposes set out in the declaration of consent and to the extent agreed therein. A given consent can be revoked at any time with effect for the future (e.g. to send our newsletter).

 

4. Who is the personal data transmitted to?

The personal data processed by us is transmitted to the following recipients:
Your data is stored on certified data centers located in Germany. The servers are operated by riatech GmbH, Althellmonsödt 50, 4202 Hellmonsödt. The service provider only has access to the data that is necessary for the operation of the server.
We use a system from PRO SOFT EDV-Entwicklungs- und Vertriebsgesellschaft m.b.H., Hobelweg 20, A-4055 Pucking to bill and create offers, orders, delivery notes, commissioning slips and invoices. The following data is stored for this: company data, contact persons and billing data.

 

5. What data is collected on the website?

5.1. Cookies

A cookie is a small text file that a website transfers to your hard drive or Internet browser to track usage of the website. Cookies are used on many websites to enable visitors to access various functions. The information contained in a cookie can be used to monitor how you use the website.
We use cookies to collect systemically relevant information about our visitors, e.g. the browser used, operating system, screen size, loading times or pages visited. It is statistical data about the browser behavior of our users and does not in itself contain any personal data. We use Google Analytics as a service provider (see point 5.2 of this data protection declaration).
We also use cookies to authenticate registered users with this information and to access their personal account. Cookies are used to simplify login behavior.
Most internet browsers offer users the option of deleting or deactivating cookies. You can delete our cookies in your browser at any time. However, a new cookie must be set to log in to your account again. If you prohibit the use of cookies, you may no longer be able to use all the functions of our website to their full extent.

5.2. Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc, (1600 Amphitheater Parkway Mountain View, CA 94043, USA; “Google”). Use includes the “Universal Analytics” operating mode. This makes it possible to assign data, sessions and interactions across multiple devices to a pseudonymous user ID and thus analyze the activities of a user across devices.
Google Analytics uses so-called “cookies”. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. If IP anonymization is activated on this website, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. The full IP address is only transferred to a Google server in the USA and abbreviated there in exceptional cases. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with other services related to website and internet use. Our legitimate interest in data processing also lies in these purposes. The legal basis for the use of Google Analytics is Section 15 (3) TMG and Article 6 (1) lit. f GDPR. The data sent by us and linked with cookies, user IDs (e.g. user ID) or advertising IDs will be automatically deleted after 14 months. Data whose retention period has expired is automatically deleted once a month. We also collect information about page views, performance data and in particular their loading times via our platforms. This use is anonymized. This is the only way we can ensure that our platforms work properly. We collect and process information about the general use of the platforms or evaluate them in an anonymous and aggregated form. This data can be passed on to third parties for the purpose of advertising and / or market and opinion research, provided the user has consented to this. You can withdraw your consent at any time. By providing their data in the course of a survey, the user agrees to the processing, storage and use of the data provided.

 

6. Newsletter

The newsletter is used as a communication channel for the following actions:
Info letter: these are essential communications (e.g. update of the terms and conditions) that may affect you. Info letters contain no advertising or product information.
Newsletter OFFTEX
We use the service of Mailchimp (The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308 USA) to send the newsletter.
As a declaration of consent, an automated e-mail including a confirmation link for the activation of the account is sent during the new registration; this contains the option of signing up for the newsletter using a double opt-in procedure. The user can specify the system to which information may be sent. You can unsubscribe from the newsletter at any time without giving a reason by clicking on the unsubscribe link at the end of each newsletter. The lawfulness of processing will not be affected until the time of deregistration.

7. Where is my data stored?

We use the SSL procedure (Secure Socket Layer) on our website in connection with the highest encryption level supported by your browser. As a rule, this is a 256 bit encryption. If your browser does not support 256-bit encryption, we use 128-bit technology instead. You can tell whether a single page of our website is transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser.

 

8. How long will my personal data be kept?

Accounts that have been idle for a period of more than 12 months will be deleted with the notification of the specified person or company. If the contract with OFFTEX is terminated on time, the account can be accessed at least 12 months after the end of the license period.
Deletion can also be carried out earlier. To do this, please apply for the data deletion request at office@offtex.at. The requested data deletion takes place within a 4-week period.
In any case, we store your personal data for as long as there are statutory retention requirements or the limitation periods for potential legal claims have not yet expired. If the processing is based on consent, the data will be stored until the consent is revoked.

 

9. What can I do personally to increase data security?

As a user, some precautions can be taken regarding data security. We regularly recommend passwords, e.g. every 3 months, to change and choose them accordingly.
A secure password consists of the following points:
At least twelve characters
Upper and lowercase letter,
Use numbers and special characters.
Devices (laptop, tablet, smartphone, etc.) with access to the account should not be left unattended and without a screen lock. Appropriate safety precautions should be taken for the devices here. In principle, every user (employee) should use their own user account in our platforms.

 

10. What rights do I have?

As a data subject, whose personal data are processed, you are entitled to:
to check whether and which personal data we have stored about you and to receive copies of this data;
request the correction, addition or deletion of your personal data that is incorrect or is not processed in accordance with the law;
to ask us to restrict the processing of your personal data;
to object to the processing of your personal data in certain circumstances;
to request data portability;
to know the identity of third parties to whom your personal data are transmitted and
to lodge a complaint with the competent authority.

 

11. Remarketing Google


This website uses the remarketing function of Google Inc. (“Google”). This function is used to present interest-based advertisements to visitors to the website within the Google advertising network. The browser of the website visitor saves so-called “cookies”, text files which are saved on your computer and which make it possible to recognize the visitor when he visits websites belonging to the Google advertising network. On these pages, the visitor can then be presented with advertisements that relate to content that the visitor has previously accessed on websites that use Google’s remarketing function. According to its own information, Google does not collect any personal data in this process. If you still do not want Google’s remarketing function, you can always deactivate it by making the appropriate settings at google.com/settings/ads. Alternatively, you can deactivate the use of cookies for interest-based advertising via the advertising network initiative by following the instructions at networkadvertising.org/managing/opt_out.aspf.
